  • not sure, but I just remember that sometime ago, there's this arcbishop of Anglican church (England church) in Vancouver had problem with arc of arcbishop from England coz. he blessed gay marriages here...
    The topis got a bit harsh at that time and some people were angry coz. of this arcbishop, Michael Ingham. Some people however were cool and gave no damn about this stuff...

    Yaaa koq nanyanya ke gw sich ? I am not a lawyer. So jawaban ini dari hasil menterjemahkan tulisan professor hukum dari University of Alberta (she is a lesbian). I will try to respond those questions.

    About registered partnership, this is a "unification" between to person under the state law to share the right and responsibility in domestic and legal area.They can share tax responsibility, property right, insurance claims, social security subsidition, and so on. It means that a person can act as the representative on the behalf of his partner. In this case, they are just like "wife and husband" in normal sense. The difference with "regular marriage" is that there is no word "marriage" in the law that regulate this registered partnership. Simply say, it is like you build a company with your partner (Don't you think that marriage is also a kind of company ?). According to registered partnership law, you have adoption right and breeding right (in Canada and Dutch). Another difference with "regular marriage " is you can't have your ceremony at church (I am not sure with this one).

    Well, about common law and civil law, according to my interpretation, in common law the judge has an active part to interpret the law and can make a decision called as jurisprudence. It doesn't need the role of legislative to amend the law. So the judge can make his own judgement on case per case basis. This law basicaly on Napoleon Law (Code Napoleon). On the other hand, in civil law the judge has restricted right to decide the case. He can't make any interpretation to the law, he just follow what the law said. If somebody feel that the law against his right, the only council that can amend the law is the House of Representative. So in this case, legislative bodies has very powerfull portion. That's why in USA the law about same-sex marriage always never stable because it depends on which party that control the Legislative bodies at that moment. Whereas is country with common law such as Dutch, there is no relation between ruling party and legislation of same-sex marriage.

    Ooooh finally it finished. Hope I don't misintrepret the book. But if it is, I appreciate any correction.
